Martinez Heavy Duty Towing provides towing and roadside assistance services, including but not limited to heavy duty towing, accident recovery, flatbed towing, winch-out service, roadside assistance, and vehicle storage in Martinez, California, and surrounding communities.
The availability of specific services, equipment, and personnel may vary based on location, time of day, demand, and other operational factors. We reserve the right to decline service requests that we determine are beyond our safe operational capacity or that involve vehicles, loads, or situations outside our service parameters.

For tows ordered by law enforcement (non-consensual tows), rates may be subject to applicable California state and local rate schedules. You have the right to request an itemized receipt for any tow.
We will make reasonable efforts to communicate any changes to estimated costs before performing additional work where practicable.
Service appointments are scheduled based on crew and equipment availability. Estimated arrival times are provided in good faith and may be affected by traffic conditions, prior service calls, weather, or other factors outside our control. We are not liable for delays caused by circumstances beyond our reasonable control.
If you need to cancel a scheduled non-emergency service appointment, please contact us as soon as possible by phone at (925) 723-9009. Cancellations made after a crew has been dispatched may be subject to a trip charge to cover dispatch and fuel costs. The trip charge amount will be communicated to you when you request cancellation.
Payment for services is due at the time of service unless otherwise agreed in writing in advance. We accept payment by cash, major credit cards, and debit cards. Fleet account customers may be subject to separate billing agreements.
If your vehicle is placed in storage, daily storage fees begin to accrue from the date of tow. You are responsible for all applicable storage fees until the vehicle is released. Storage fees will be communicated to you at the time of drop-off.
If payment is not received when due, we reserve the right to exercise any applicable lien rights under California law with respect to vehicles in our possession.

Providing false or misleading information that results in incorrect equipment dispatch or unsafe conditions may affect your rights under these Terms.
To the fullest extent permitted by law, Martinez Heavy Duty Towing shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services or your use of our Site, including but not limited to lost profits, loss of data, or loss of business, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to a specific service event shall not exceed the total amount you paid us for that specific service.
We are not responsible for pre-existing damage to vehicles prior to towing. Our crew will document and note pre-existing damage before performing service. You should review and agree to that documentation before service begins.
Our services and our Site are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the fitness of our services for any particular purpose, uninterrupted availability, or freedom from errors.
We do not warrant that towing or recovery services will prevent all further damage to a vehicle. The nature of accident recovery and heavy vehicle towing involves inherent risks that cannot always be eliminated.

If informal resolution is not possible, any dispute shall be resolved through binding arbitration in Martinez, California, under the rules of the American Arbitration Association, unless you and we agree otherwise in writing. You waive any right to a jury trial or to participate in a class action lawsuit.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought in the courts of Contra Costa County, California.
We reserve the right to update or modify these Terms and Conditions at any time. Changes will be posted on this page with a revised effective date. Your continued use of our Site or services after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.
